TERMS AND CONDITIONS - PRODUCTS (EU CUSTOMERS)

INTRODUCTION
We are Gutology Limited. Our company information is at the end of this document.

These are our terms and conditions which apply when you buy any goods from us via our website. (Separate terms apply when you use our testing service or our website generally.) Please read the entire document carefully and contact us if anything is unclear. We’ve tried to make it user-friendly but please note that the summaries/explanations for each section in capitals aren’t a substitute for the rest of the text. Please save a copy for future reference. These terms are only available in English and they replace any previous versions. Where we refer to “Consumer” below we mean an individual acting for purposes which are wholly or mainly outside that person’s trade, business, craft or profession.

WHO CAN BUY ON OUR SITE
You may place an order on our site provided that the product you are purchasing is suitable for your age group. All relevant age restrictions are listed in the Help Centre section of our website under each product category. You may purchase goods either for your own use or as a gift for someone else, provided that any recipient meets any applicable age restrictions for the product and is encouraged to review the list of ingredients to ensure suitability for their individual needs. Orders are accepted from both the UK and EU countries where delivery is available. You are not allowed to buy our goods if it is unlawful to do so in your country.

IMPORTANT WARNINGS
Our products are not intended to diagnose, prevent, or treat any medical condition and are not a substitute for professional medical advice. You agree to consult your health professional before using our products. You are responsible for checking all ingredients to avoid allergic or adverse reactions.

GIVING US INFORMATION
You agree to ensure that all information you provide, including delivery address, is accurate and up to date. Additional delivery charges may apply if an incorrect address results in the return of the parcel. 

HOW YOU ENTER A LEGAL CONTRACT WITH US 
You place an order using the ordering process on our website. A legal contract is formed when we send you a confirmation email. Subscriptions are part of this same contract.

UNAVAILABILITY
We are not obliged to supply goods that become unavailable, even after accepting your order. You will receive a refund for unavailable items.

PAYING US
Prices include VAT or other applicable sales taxes, including EU VAT where relevant. Payment is in advance. Subscriptions auto-renew unless cancelled at least three days before renewal. Delivery charges will be shown at checkout. For deliveries outside the EU, customers are responsible for customs/import charges. You must update your payment information as necessary.

DISCOUNT CODES
Discount codes apply only to future new orders and exclude delivery charges. Only one code may be used per transaction. Codes must not be transferred and are subject to cancellation if misused.

OUR RIGHT TO END THE CONTRACT
We may cancel the contract if payment is not received, if you act inappropriately, or if you breach these terms.

DELIVERY
We deliver to selected UK and EU countries. Goods sold to EU customers are dispatched from within the EU. Delivery times are estimates only. If a parcel is undeliverable and returned, we may cancel the contract and issue a refund excluding delivery charges.

COOLING OFF / RETURNS
If you are a Consumer in the EU, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period ends 14 days from the day you (or someone you nominate) receives the goods. You must notify us clearly (e.g. by email) and return the goods at your own cost. Refunds will be made within 14 days of us receiving the returned goods or proof of return.


RESTRICTIONS ON OUR LEGAL RESPONSIBILITY
Nothing limits our liability for death or injury caused by negligence or for fraud. We are not liable for indirect or unforeseeable losses. EU Consumers retain all legal rights regarding faulty or misdescribed goods.

INTELLECTUAL PROPERTY RIGHTS (IPR)
Your purchase does not give you any rights to use or exploit any intellectual property in the goods.

We handle personal data in accordance with our Privacy Policies. Our EU representative is Advanced Development & Safety Laboratories (Ireland) Ltd, who acts in a regulatory capacity only. All customer service and privacy-related enquiries should be directed to us at [email protected].


THINGS WE CAN'T CONTROL
We are not liable for failure or delay caused by events beyond our control.


TRANSFERRING THIS CONTRACT
We may transfer this contract. You may not transfer it without our written permission.

ENGLISH LAW AND COURTS 
These terms are governed by English law. Disputes will be resolved in UK courts unless mandatory laws of your country of residence apply. EU Consumers may bring claims in their home countries.
